1. The Service Provider
1.1. Mundo das Velas, Unipessoal Lda., hereinafter named Bouticandles, with the tax identification number 516039350, registered at the Lisbon Trade Registry Office under the same number, with head offices at Rua dos Pescadores, Apartamento 102, Edifício Galeão, 8400-512 Carvoeiro – Lagoa, provides the Customer with the Services described on the website https://bouticandles.com/ under the brand name “Bouticandles – boutique das velas” (candles boutique).
1.2. In order for Bouticandles to provide the Service, the Customer should provide all the details requested (mandatory details) on the order form, under penalty that the provision of some or all of the Services requested could be refused while the necessary information is not provided.
2. Products
The products sold by Bouticandles are new and genuine.
The products are packaged in boxes.
All the products sold by Bouticandles are in accordance with the Portuguese law.
The prices are stated in Euros (EUR) and include VAT at the legal rate in effect.
3. Conditions of Service Provision
3.1. Bouticandles undertakes to carry out the necessary steps to provide the Services within the period agreed upon with the Customer, which is identified on the order form.
The Customer also acknowledges and accepts that Bouticandles does not control the content of the information transmitted or disclosed by the Customer by means of the communication networks it uses.
3.2. Bouticandles undertakes to keep secret and maintain confidential all the details, contents, information and elements disclosed and provided by the Customer within the scope of the signing and implementation of this contract, regardless of the medium in which they are, notwithstanding that provided for with regard to the use of personal details.
3.3. It is the exclusive responsibility of the Customer to ensure that the equipment, operating systems or IT programs it uses, are appropriate for the use of the Service, under the terms described on the order form.
This contractual tool contains the General conditions for the provision of services applied by Bouticandles and the Customer, under the terms indicated on the order form, is aware that the Services that will in particular be provided to him are also subject to specific conditions stated in specific tools that the Customer declares he read and with which he agrees and accepts.
3.4. Bouticandles declines any responsibility in case of violation of the laws of the country where the products are delivered. It is up to the Customer to check with the local authorities what the import conditions are or those of the use of the products he intends to order.
3.5. Bouticandles is not responsible for losses caused to the User for the use of the Internet network resulting from interferences, external intrusions, interruptions, IT viruses, breakdowns or disconnections of the IT system or any other case of force majeure.

5. Customer’s Obligations with regard to the use of the Service
5.1. The Customer and the User should comply with these general conditions and respect them.
They namely undertake to comply with the following obligations:
a. Save, and not disclose, their username and authentication password for the Online Store in order to prevent that third parties access their account.
b. Not use false identities.
c. To provide personal details and correct addresses so that Bouticandles may appropriately process the orders.
5.2. The Customer is responsible for the veracity of the details communicated to Bouticandles and undertakes to inform of any change to said details.
5.3. Bouticandles declines any responsibility for possible delay of or impossibility in processing the order, namely with the delivery, resulting from error or insufficiency of the details communicated by the Customer.
5.4. The Customer acknowledges and accepts that it should keep, under its own exclusive responsibility, a copy of all the Service order requests/subscriptions made through the https://bouticandle.com website, as well as of all the documents pertaining to invoicing and payments made to Bouticandles.
6. Electronic Invoicing
6.1. The Customer acknowledges and accepts that Bouticandles, will issue electronic invoices in return for the provision of Services subscribed by the Customer, whereby they will sent to the e-mail address indicated by the Customer in his Reserved Area, as well as all the accounting documents that prove to be necessary for the correct and valid invoicing of the services provided to the Customer.
6.2. The Customer also acknowledges and accepts that he may opt to receive the accounting documents indicated in the previous point via CTT (mail), whereby he should for the purpose deactivate the “electronic invoicing” option by means of the administration panel of his account or communicate said intention by means of the support request he may open through his customer area.
7. Carrying out an online order
In order to carry out purchases through the Online Store of Bouticandles it is necessary to carry out your registration.
After surfing through the categories that are of interest to the user, clicking on the products to view the details, you only need to click on the buy button to add the products you intend to purchase to the “Cart”.
You should follow all the steps of the purchase so that it is successfully completed.
Bouticandles informs that the prices applied on the Online Store are exclusive to Bouticandles and that they may vary from the prices of the Bouticandles physical store.
The validation of the order implies that the Customer is aware of and accepts the General Conditions of Sale.
The details registered by Bouticandles constitute proof of the set of transactions carried out between Bouticandles and the Customer.
It is the responsibility of Bouticandles to file the electronic document in which the contract is formalized and to keep it accessible.
As soon as you complete your order, you will receive an automatic e-mail confirming the transaction. Should the details not be correct, you should immediately request the alteration thereof, or even, the cancellation of the purchase made.
8. Duration and Termination
8.1. These General Conditions for the Provision of Services have the duration stipulated for each of the contracts pertaining to the Services the Customer subscribes to, which will have the duration indicated on the order form, whereby they will not be automatically renewed, unless the Customer manifests the specific and unequivocal will that the contract should be renewed automatically, activating the option “automatic renewal” on his control panel for the purpose.
8.2. The Customer acknowledges that the termination of these General Conditions for the Provision of Services will determine the termination of all the contracts with Specific Conditions in effect at the time of the communication of the termination, with the contractual and legal consequences that result therefrom.
8.3. The termination by the Customer of any of the specific conditions in effect will only determine the termination of these General Conditions for the Provision of Services if no other service (and respective specific conditions) is active.
The definitive cancellation of the service determines the definitive loss of the details kept on the server, whereby the Customer has the obligation to safeguard said details before the definitive cancellation of the service, should he intend to keep them.
9. Means of payments available
Bouticandles provides 3 means of payment for the online orders:
- Bank Transfer
- ATM
- Credit Card
10. Responsibility
10.1. Bouticandles may only be held responsible for the losses or damages resulting from the breach or faulty compliance of this contract that are attributed to it by way of willful misconduct or serious fault, whereby it is not responsible, namely, for (i) damages caused due to the fault of the Customer or third parties, (ii) that result from the fulfillment of legal decisions or administrative authorities, (iii) operating losses or (iv) that result from the ocurrence of situations of force majeure, or rather, situations of an extraordinary or unpredictable nature, exterior to Bouticandles and that may not be controlled by it, such as fires, power cuts, explosions, wars, riots, civil insurrections, governmental decisions, strikes, earthquakes, floods or other natural disasters or other situations that cannot be controlled by Bouticandles that prevent or harm the fulfillment of the obligations assumed under cover of this contract.
10.2. The Customer specifically acknowledges and accepts that Bouticandles exclusively limits itself to providing the Services, whereby it is not responsible for the content of the information or any other details provided or received via the Internet or the communication networks, nor for facts or circumstances that highlight the illegality thereof.
11. Claim and extrajudicial resolution of disputes
11.1. Before resorting to any court or arbitration, the Customer undertakes to try to solve the dispute by notifying Bouticandles by electronic mail or by registered mail of the content of his claim. In turn, Bouticandles undertakes to assess the claim, notifying the Customer, in writing, of its conclusions within a maximum period of 8 (eight) working days counting from the Customer’s notification.
12. Specific Rules applicable to “Consumers”
12.1. Should the Customer be a “Consumer” under the terms of the definition provided for in Decree-Law 24/2014, 14 February, which governs the contracts signed remotely and outside the commercial establishment, it is considered that he is informed for all purposes that he has a period to terminate this contract of 14 (fourteen) days counting from the date of the signing of this contract should the mere provision of services be in question, without the payment of compensation and without the need for any justification, whereby in that case, Bouticandles should refund the Customer for the Service’s activation rate, should there have been payment thereof.
12.2. Under the terms of that provided for in article 18 of Law 144/2015, 8 September, Bouticandles informs its Customers that are Consumers, in accordance with the definition stated in the legal document mentioned, that the complete list of Entities (RAL – Entidades de Resolução Alternativa de Litígios de Consumo) – Entities for the Alternative Resolution of Consumption Disputes that exist in Portugal is available for consultation on the Consumer’s Portal accessible by means of electronic address http://www.consumidor.pt .
12.3. Bouticandles also informs its Consumer Customers of the existence of an online platform for the resolution of disputes that can be used when the Parties reside in an E. U. State – RLL Platform and that is accessible by means of the electronic address http://ec.europa.eu//consumers/odr/ .
12.4. Bouticandles also informs its Customers that are consumers under the terms mentioned above, that for the purposes of Alternative Resolution of Disputes, its e-mail address is info@bouticandle.com .
13. Availability of products
Bouticandles only processes the orders after confirmation of the respective payment, whereby Bouticandles cannot ensure the availability of the products until the start of the processing mentioned.
You can find the availability of the article on the product’s form, to which the time of transport must be added depending on the carrier and the destination of your order.
Bouticandles only makes shipments on working days. Thus, weekends or public holidays do not count for the estimate of delivery of orders.
Any delay noted in the shipment of products, in light of the estimate dates presented, does not grant the right to compensation.
14. Shipping charges
The shipping charges are notified when the purchase is made.
The transport of the products is covered by insurance against losses that may occur during transport.
The product is very carefully packaged in order to avoid damages during transport so as to ensure the customer’s full satisfaction.
15. Exchanges and returns
Applicable to purchases made online:
Within the scope of its Customer Satisfaction Policy, and under the legal terms applicable, Bouticandles enables the exchange or return (termination of the contract) of products, within a period of 5 days counting from the date they were received on by the Customer, without payment and without the need to indicate the reason.
To this end, the Customer should inform Bouticandles of his intention in writing, via e-mail or letter. The products should be returned within a period of 15 days after having been received accompanied by the respective invoice.
The products should not be sent without prior contact under any circumstances as they will not be received.
The return and exchange of products should respect the following conditions:
Restitution of the products in a good state without any sign of use, with the original and complete package and other elements that accompany the product, namely, certificates of warranty, protection sheets, safety labels and accompanied by the respective invoice;
We do not accept exchanges of products personalized in accordance with the Customer’s specifications;
The Customer is responsible for the transport of the product, namely costs, misplacements, damages that it may be subject to during transportation and delays.
After contact with Bouticandles and having been given the indications for return, you should send us the product to our address:

All the products will be checked upon arrival at our service and only those that respect the exchange conditions will be accepted for exchange.
In case of exchange and reshipping, we inform you that:
- Shipping charges will be debited
- Collection charges will be debited if the order was sent for payment on delivery;
- Bouticandles reserves the right not to accept products that do not comply with these conditions.
16. Product information
We have taken the appropriate precautions in order to ensure that all the details, descriptions and prices of the products presented on the site are correct. However, we reserve the right to refuse orders where the product information was incorrectly published, including prices and promotions.
The refusal of orders may also be a result of other reasons, such as:
- Product out of stock.
- Inability to obtain payment authorisation.
- Fraudulent orders.
If there is any problem with your order, you will immediately be contacted by us.
We do everything that is within our reach to keep the details of your order and payment safe. But we cannot be held responsible for any loss that you may experience, if a third party is able to gain unauthorized access to any details that you provided when accessing or ordering on our site.
Bouticandles – may change the prices without prior notice. All the prices include VAT (where applicable) at the legal rate in effect.
17. Announcements and notifications
17.1. The announcements and notifications made under cover of this contract will be carried out, unless otherwise provided for, to the electronic mail address of Mundo das Velas, Unipessoal Lda., stated on the website of Mundo das Velas, Unipessoal Lda. and to the Customer’s electronic mail address, stated on the order form, whereby Mundo das Velas, Unipessoal Lda. may also make said announcements to the Customer’s invoicing address.
17.2. Under the terms of article 229 of the Civil Process Code, for the purposes of citing the Customer within the scope of a legal proceeding aimed at the fulfillment of financial obligations arising from this contract, the Parties stipulate the address indicated on the order form as the residence agreed upon.
17.3. The Customer and Mundo das Velas, Unipessoal Lda. are obliged to mutually inform one another of any change to the address indicated on the order form, within a maximum period of 30 (thirty) days, by means of registered letter with notice of reception, under penalty of the other Party considering it to be cited at the address initially indicated.
18. COMPLAINTS
In accordance with DL 156/2005, dated 15 September, changed by Decree-Law 74/2017, dated 21 June, for any complaint in relation to our services, you may access the online complaints bookto carry out a complaint.
19. Legislation applicable
19.1. The legislation applicable to any contractual relation that is established through the Online Store of Mundo das Velas, Unipessoal Lda. is the Portuguese law.
The Court of the county of Lisbon will be competent for settling all and any conflict arising from any contract signed under the terms of these General Conditions of Sale, with express waiver of any other.
